Kilmar Abrego Garcia is a husband, father of three, and a sheet metal union worker. He was deported and later detained in a Salvadoran prison because of the administration’s claims he has connections to the MS-13 gang. According to his attorney, Hillary Walsh, the U.S. government has no proof of the affiliation, other than the statement of one witness, and he has never been charged with a crime while living in the country.
Garcia escaped gang-related violence as a teenager and gained legal authorization to stay in the U.S. in 2011. An immigration judge determined that he was eligible for refuge and issued a court order barring his deportation in 2019.
Some Americans are calling Garcia’s deportation a constitutional crisis, and the real questions here revolve around due process. Rep. Ansari states that these rights are a priority to her and her constituents, many of whom have reached out to her office for action.

The U.S. Supreme Court acknowledged Garcia’s 2019 deportation ban in April 2025 and ordered the Trump administration to facilitate his return. However, according to Attorney General Pam Bondi, that decision is up to El Salvador’s President Nayib Bukele.
In a White House meeting with the president, Bukele said he had no plans to release Garcia. Unfortunately, there is nothing the Congresswoman is able to do, as she does not have the power to enter a foreign country and bring one of their citizens back to the U.S. The Trump administration has also made it clear that they don’t want Garcia back.
Ansari visited El Salvador alongside Reps. Robert Garcia, Maxine Dexter, and Maxwell Frost, to press for Garcia’s return. These Congressional members aim to bring attention to the president’s illegal defiance of the Supreme Court’s decision.
This Democratic delegation wants the Administration to bring Garcia home safely to the U.S. While the group had planned to investigate Garcia’s current condition, their request to see him was denied. Ansari affirmed that more congress members would be paying El Salvador a visit in the near future to seek remedy for the illegally deported Garcia. Maryland’s senator, Chris van Hollen, did end up meeting with Garcia to confirm his current condition.
